MEDIATION




be accepted where all parties to a dispute are in agreement that the case is
appropriate for Mediation. Parties should contact the Mediator by email or
phone to indicate there is an Agreement to retain the Mediator. The Mediator
will be in direct contact with counsel to complete a Mediation Agreement,
arrange for scheduling the Mediation, payment of fees and submission of
documents, pleadings and a Mediation Summary.

Mediation will be scheduled at a neutral facility centrally located in New
Hampshire, unless the parties agree to schedule the mediation at another
location, and will be scheduled for a one-half day or a full day session at the
request of the parties. The normal charge for Mediation services is $1200 for
a one-half day Mediation and $2000 for a full day Mediation, to be divided
between or among the parties. This fee includes all of the Mediator's time for
review and preparation, travel and conducting the Mediation. The parties are
also responsible for sharing the cost of the site for Mediation of $200 for one -
half day Mediation and $300 for a full day Mediation. If the parties elect to
conduct the Mediation at the offices of one of their counsel, the site fee is
waived. In the event that additional time is necessary to complete the
Mediation, the Mediator’s hourly fee is $225 per hour.

All fees for scheduled Mediations are due to the Mediator 14 days prior to the
scheduled Mediation date or in the case of additional hourly fees, within 20
days of the time the additional Mediation fees are incurred. Fees for a
scheduled Mediation are not refundable unless the Mediator is given notice
that the case has been settled and Mediation is unnecessary at least 7 days
prior to the date of the scheduled mediation. There is no fee or charge to
reschedule a Mediation due to a schedule conflict or where the parties are in
agreement to the rescheduling of the case.

location, and will be scheduled for a  minimum 2 hour or a one-half day or a
full day session at the request of the parties. The normal charge for Mediation
services is $250 per hour with $500 deposit per party. The parties are also
responsible for sharing the cost of the site for Mediation, payable in advance
of Mediation or at the conclusion of the Mediation, depending on the
circumstances. If the parties elect to conduct the Mediation at the offices of
one of their counsel, any site fee is waived. The Mediator’s hourly fee is $250
per hour, for review of pleadings, documents and summaries, and travel to
and attending mediation sessions, divided among or between the parties.

The per party deposit of $500 is due 14 days prior to the scheduled Mediation,
unless waived, and additional hourly fees incurred at $250 per hour and the
site fee, if applicable, are due to the Mediator within 10 days of the time the  
fees are incurred. In any action to recover unpaid fees, the Mediator shall be
entitled to recover costs and attorney's fees. There is no fee or charge to
reschedule a Mediation due to a schedule conflict or where the parties are in
agreement to the rescheduling of the case, where notice is given 72 hours
prior to the scheduled Mediation. Parties are responsible for any cancellation
fees as to any site reserved. Minimum fees paid in advance are not refundable
unless the parties give the Mediator notice that the matter has settled or
request rescheduling at least 72 hours prior to the scheduled Mediation.
